In no event will Excel or any of its suppliers be liable to you for any consequential, indirect, exemplary, special or incidental damages including any lost data and lost profits, arising from or relating to the web site or any activities conducted in connection with the web site, even if Excel or its suppliers have been advised of the possibility of such damages.  Excel and its suppliers' total cumulative liability in connection with these terms and conditions or the use of this web site, whether in contract or tort or otherwise, will not exceed fifty Canadian dollars (Cdn. $50).  The existence of more than one claim will not serve to increase such foregoing dollar limitation.

These terms of use shall be governed by and construed under the laws of the Province of Saskatchewan.  Any action or proceeding arising from or relating to these terms and conditions must be brought in a provincial court in Regina, Saskatchewan, Canada, and you irrevocably submit to the jurisdiction and venue of any such court in any such action or proceeding.  If any provision of these terms of use is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.  Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches.

These terms of use shall be amended by Excel in its sole discretion by posting the amended terms of use at this Universal Resource Locator (URL) and affected discussion forums by posting notice of amendment no less than five (5) days prior to the effective date of such amendment. You agree that any continued use of this web site after the effective date of such amendment shall signify your express acceptance of any such changes.
